Senate President Wants Judge To Reconsider Previous Ruling On Road Plan

Frankfort, KY – In July, Franklin Circuit Judge Phillip Shepherd nullified the General Assembly's 2008 highway construction bill because he said it didn't reach Governor Beshear on time. The bill was approved after midnight on the last night of the 2008 session.
Shepherd said it had to be to the governor before midnight April 15th, even if lawmakers had to "nail the legislation to the governor's door." The governor later vetoed the bill and said he would develop his own road plan.
Senate President David Williams is challenging both actions and wants Judge Shepherd to reconsider his earlier ruling. Gov. Beshear wants the case dismissed. Judge Shepherd heard arguments from both sides this week, but made no immediate ruling.
