Father Files Lawsuit Over Daughter's School Placement

A Lexington man is suing Fayette County Schools because he doesn’t agree with the school the district assigned his daughter to attend.

Anthony Wilson filed the lawsuit in December because his daughter was placed in Southern Elementary for kindergarten instead of his choice, Veterans Park which has higher test scores and is about a mile away from the family’s home.  That suit has just been moved to U.S. District Court out of Fayette Circuit Court.

In Fayette County, students whose parents work in a school, walkers within a mile of a school, siblings, 5th graders who have always attended the same school and families that are moving before October 31st of each school year are given priority admission to each school.  There are also rare instances when a child can be moved if their school isn’t meeting their required needs. The district denied Wilson’s request for an out-of-area transfer.  He appealed that decision.

Robert Chenoweth, an attorney for the Fayette County school district, told the Lexington Herald Leader that the district had asked in court for more information on Wilson's concerns and position but said he couldn't discuss the merits of the case.
