Activist Groups Say Coal Company Falsified Reports

LOUISVILLE, Ky. – A coalition of environmental groups says it intends to sue a Kentucky coal operator under the federal Clean Water Act for allegedly falsifying state water quality reports.

The groups said Wednesday that Bardstown, Ky.- based Nally and Hamilton Enterprises committed 12,000 violations of federal law by filling out water permitting reports with inaccurate or repetitive information. The groups say they discovered the violations while reviewing state documents earlier this year.

The environmental groups are Appalachian Voices, Kentuckians for the Commonwealth, Kentucky Riverkeeper and Waterkeeper Alliance, which is led by Robert Kennedy Jr.

The activists filed a similar action last year against two coal companies, ICG and Frasure Creek, which have surface mining operations in Kentucky.

A message left for a Nally & Hamilton spokesman Wednesday was not immediately returned.
