House and Senate negotiators met for about two hours Thursday but didn't reach agreement on a bill that would battle the state's growing heroin problem.
Senate Republicans want to increase penalties for anyone found with any amount of heroin. But House Democrats only want to increase penalties for people arrested with more than 60 grams of heroin.
Senators argue the increased penalties will keep drug dealers off the street and make it harder for people to get heroin. But House members say the only thing that would do is fill up the state's prisons and increase costs.
Lawmakers have until midnight on Tuesday to pass a bill. Heroin overdose deaths in Kentucky have jumped nearly 1,000 percent since 2011.
