FRANKFORT, Ky. – The Family Foundation of Kentucky wants a say in the court case testing the legality of instant racing. The state's horse racing commission is seeking a judicial ruling on Instant Racing, or electronic wagering on previously run races.

Martin Cothran of the Family Foundation says Instant Racing is just another form of casino gambling.

"We think the governor has decided to give a benefit to a special interest here on this. And he's trying to push a regulation through that really has some constitutional issues. And we're going to point out those issues."

A hearing on the foundation's request to intervene in the court case will be held next week. Late next month, the racing commission will hold a public hearing on new regulations to allow Instant Racing in the commonwealth.
