Bevin Administration Files Lawsuit To Close Abortion Clinic In Lexington

The state has filed a lawsuit against a Women's Clinic in Lexington, saying it is an unlicensed abortion facility and should be closed.

The Cabinet for Health and Family Services filed the lawsuit Wednesday against Eubanks & Marshall of Lexington, P.S.C. to stop it from operating a facility that "has performed abortions without a license and a required emergency transfer agreement."

Vickie Yates Glisson, secretary of the Cabinet for Health and Family Services, said in a statement that the cabinet was notified of the situation last month.

Glisson noted that the facility at 161 Burt Road had not been inspected by the cabinet since 2006, and that when inspectors showed up last month they determined that "the facility exists solely to perform abortions."

They also found that the clinic maintained a "significant quantity of expired medication, and was unsanitary" falling far below state requirements.
