Lexington, KY – Glen Doneghy, the man convicted on June 30th of second-degree manslaughter in the hit and run death of Lexington police officer Bryan Durman, could get a new trial, if a motion filed by one of his attorneys is successful. Josh James has the story.
In a motion filed Wednesday, an attorney for Glen Doneghy says jurors in his trial were allowed to take an unsupervised lunch break during their June 30th deliberations.
The motion argues the jurors should have been kept in a group and accompanied by a court bailiff; and allowing them to move about freely was a violation of Kentucky law.
In an affidavit accompanying the motion, Defense Attorney Kate Dunn says Fayette Circuit Judge James Ishmael called her and told her he'd approved the jury's request to go out for lunch but did not mention that they would be on their own.
Doneghy is scheduled to be sentenced August 19th. The jury recommended he spend thirty years behind bars.
